🧠 Instagram and Facebook design violates DSA rules

The European Commission announced on Friday that, according to its preliminary finding, the so-called addictive design of the Instagram and Facebook applications violates the Digital Services Act (DSA).

The Commission states that Meta has not sufficiently assessed the risks that elements such as infinite scrolling, automatic video playback, or push notifications pose to the physical and mental health of users – including minors. According to the EC, the time management tools Meta has introduced do not lead to a real reduction in platform usage. The company can now respond to the findings and review the investigation files. If the Commission confirms its conclusion, Meta faces a fine of up to 6% of its total annual global turnover (over $12 billion).

For the company, this means additional regulatory risk in the EU alongside ongoing disputes related to the DMA and data protection – the final amount of any penalty and the decision timeline are not yet known.
